Interim Order or Arbitral Award?
Interim relief in international commercial arbitration serves to preserve the effectiveness of a future arbitral award.
Depending on its content and function, the instrument may constitute an interim order or provisional measure, but in certain circumstances, it may also resemble an arbitral award determining a distinct and autonomous issue.
Its legal character determines its binding effect, enforceability, recognition, and the judicial mechanisms available for review.
Before asking how to challenge an arbitral decision, ask what it legally is.
