Machas & Partners Labor & Employment Managing Partner Maria Antoniadou and team, won the court appeal and the additional ground of appeal representing one of the largest companies in the printed media distribution sector in Greece.
The Court of Appeal in Athens, after taking into consideration the criteria that could be advocate for maintaining or not the identity of an economic unit, reached the conclusion that there was no transfer of the undertaking and contractual relations to our client. Thus, the transfer of customers, which was in conjunction with business type, has not been the subject of an agreement between the two enterprises, but was caused necessarily while these two were exclusively active in the distribution sector throughout Greece and the closure of the first would involve in the customer transfer to the other.
